How drunk you must be before it is no longer responsible for you to gamble, and does the casino have a responsibility towards drunken players?

Mark Johnston, a businessman and gambler from Southern California thinks that casinos should not allow players to play drunk and most certainly should not be fueling their players with more alcohol when they are already inebriated.

Johnston is suing the Downtown Grand Casino in Las Vegas for loaning him money to continue gambling while he was drunk, and for continuing to serve him drinks when he was already visibly drunk.

The Downtown Grand opened in the old part of Las Vegas just four months ago and Johnston claims her was drunk during the long hours he spent playing blackjack and Pai Gow, while the casino kept serving him more and more complementary drinks.

The Nevada State Gaming Control Board is investigating the matter and Johnston’s legal team has said it has plenty of eyewitness testimonies and surveillance videos of the casino itself that will help them prove that the casino was in the wrong.

Sean Lyttle, Johnston’s lawyer has stated that "It's certainly an extraordinary case. This is not a story that I've ever heard before, where someone was blackout intoxicated where they couldn't read their cards, and yet a casino continued to serve them drinks and issue them more markers. It's a very heavy-handed and unusual approach that we haven't seen in this town in a long time."

The Grand Casino refused to comment saying they never comment on ongoing litigation.
