Mardi Gras Casino Wins Suit against Obese Blackjack Dealer 01.08.2013

Disability discrimination is a hot topic these days, and tough legislation can penalize companies heavily if they fail to treat disabled employees equally. However, this does not necessarily mean that the law will always be on the side of the disadvantaged party, as a new case involving the Mardi Gras Casino in West Virginia has revealed.

One of West Virginia’s former blackjack dealer’s (named Andrew O. in the media) was fired for being very overweight. The man, who weighed in at an astounding 540 pounds, could not keep his shirt tucked into his pants despite wearing a specially tailored 7X shirt. He was also unable to walk to the employee break area during his 25-minute break without becoming exhausted. He was repeatedly warned about the possibility of losing his job unless he solved the problem and was eventually fired in 2010. This led to a lengthy battle which has only recently drawn to a close. The man initially claimed that he had a disability and was being discriminated against, but has in the end lost his case as the court decided that the casino had made “reasonable accommodations” for the man, including an alternate break area.

This case is reminiscent of another current case involving a blackjack dealer’s battle against the casino she works for in the attempt of being allowed to wear normal shoes rather than heels at work. The cases certainly make one wonder how far big-name and extremely image-conscious casinos are willing to bend backward to accommodate blackjack dealers.
