US Department of Justice in U-turn on Online Gambling 26.12.2011

US poker and casino players received a special gift for Christmas this year in the form of a change in the stance that the Department of Justice (DoJ) has maintained since online gambling first came onto the scene.

The DoJ maintained that all forms of online gambling were illegal in the US based on the Federal Wire Act of 1961. For many years the DoJ refused to accept the stand that the US Court of Appeals adopted with regards to the law and that is that the Federal Wire Act prohibits the transmission of bets made on sporting events and not any other form of gambling.

Since the US Supreme Court did not come out in support of the decision made by the Court of Appeals the DoJ felt it was justified in applying the Federal Wire Act to all forms of online gambling. Now the DoJ has made a complete U-turn and accepted that the application of the law should be made for sports betting only.

Some experts say that the DoJ does not need the Federal Wire Act in order to bring an action against companies and financial institutions that partake in offering or facilitating online gambling for US players. This is due to the Unlawful Internet Gambling Enforcement Act ( UIGEA ) that was passed in 2006 and specifically dealt with the legalities of online gambling in the US by prohibiting any US-based or offshore companies from offering such services to US residents.

The new DoJ stance is welcomed by industry leaders, online poker and casino operators and millions of frustrated US players that are banned from playing on reputable gaming platforms and therefore resort to playing with unlicensed operators.
